Article 1: Agreement
1.1 This agreement contains the general terms and conditions applicable to the information and services offered by ITdaily, a website offered and hosted by ForLink BV. The user (visitor, customer, partner or supplier) of the website and of any services offered, is deemed to have read and agreed to these general terms and conditions.
1.2 ForLink BV reserves the right to modify these terms and conditions at any time. If any changes occur within these terms and conditions this will be announced on the website and the amended terms and conditions will automatically be in force for each user.
1.3 Also, ForLink BV’s general terms and conditions apply to any contract between a user for the entire duration of this contract.
1.4 In the event of a very major change to these terms and conditions, ForLink BV will notify the user by email, if known.
Article 2: Liability
2.1 ForLink BV is not responsible for inaccuracies or shortcomings, or any other defect in the data or information published on the website. This applies to any data or information posted by ForLink BV, or any employee of ITdaily, as well as to any contributions made by users.
2.2 ForLink BV provides the website as it is at that time. This is done using highly advanced techniques. ForLink BV is not liable for any breakdown or malfunction of the web site.
2.3 The website contains several links to third-party websites. No control is exercised over the information or policies provided by these websites. Therefore, ForLink BV is not responsible for any information or data on third party websites. This does not mean that ForLink BV in any way endorses or has any association with any third party’s opinion/information/data.
2.4 Any shortcomings in the information or data provided by ITdaily does not entitle the user to any form of financial compensation. ForLink BV is not liable to users or third parties for any direct, indirect or incidental damages, loss of profits, consequential damages or for damages caused by negligence or forgetfulness in providing, compiling, assembling, writing and interpreting information.
2.5 The information and data on the Web site are changed with high frequency. ForLink BV therefore reserves the right to make improvements and/or changes to the Web site at any time.
Article 3: Intellectual property and copyright
3.1 The user expressly acknowledges that the intellectual property rights to the Web site and the data published therein (texts, photographs, images, layout) are and remain in the hands of ForLink BV.
3.2 It is forbidden for any user, or third party, to publish or reproduce any information published on the website without ForLink BV’s prior written consent. This information may therefore not be reproduced, published, sold or distributed in any other form, other than through itdaily.
Article 4: Privacy Policy
4.1 ForLink BVs respects the data and privacy of its users. ForLink BV has created a separate privacy statement which forms part of this agreement. In summary, we only use personal data to provide an optimal website and experience. If there is any question of us sharing personal data with an external party, the user has to give explicit permission. Some exceptions are the Tax Office, if there is a commercial agreement or when we are legally obliged to do so. We are a Dutch company and follow Dutch law.
4.2 During a visit to the website, we may store information on the user’s computer in the form of a Cookie. A Cookie is a very small file in which basic information is stored. A Cookie can be used to find out when the user has been on ITdaily before and whether the user has certain preferences on our website. You can manage your cookies on ITdaily via the link. Article 5: Unforeseen situations
5.1 If a situation arises that is not provided for in the Terms and Conditions or Privacy Statement, it can be submitted to ForLink BV at info@forlink.be. ForLink BV will then respond and that response will be binding.
