Elon Musk’s attempt to challenge OpenAI’s transition to for-profit has been immediately rejected by a federal court in the US.
OpenAI is in the process of transforming from a complex non-profit structure to a more conventional for-profit company. Elon Musk tried to obstruct this transformation, claiming that OpenAI is developing its AI for profit and not for the benefit of society.

However, Musk was unable to gather enough evidence to substantiate his case. He alleged that OpenAI had violated antitrust rules by asking investors in the company not to support competitors. According to him, the company would also be in breach of commitments made to early donors, including Musk himself. He helped found OpenAI but left the company shortly after.
In 2023, he founded his own AI company, xAI, and wants to compete with ChatGPT and others using the Grok AI model. Meanwhile, the value of that company is said to be 45 billion dollars. Musk and OpenAI’s CEO Sam Altman are no longer friends, as there has long been a feud between the two gentlemen. Recently, Musk offered 100 billion dollars to buy out the non-profit branch of OpenAI. Altman did not agree and said he ‘wanted to take over Twitter for 9.74 billion dollars.’
